On-Line Banking and Bill Payment Service Agreement
This On-Line Banking and Bill Payment Agreement, (“the Agreement”) sets forth the terms and conditions governing your use of any On-Line Banking Services and Bill Payment Services offered by Valley Bank of Helena. All existing and future On-Line Banking Services offered by Valley Bank of Helena are referred to as “On-Line Banking Services” in this Agreement. By using any of the On-Line Banking Services, you agree to abide by the terms and conditions of this Agreement as well as your Deposit Account Terms and Conditions on file with the bank (which may be accessed by calling a Valley Bank of Helena office, or clicking on the Disclosure section of this site).
Anyone with access to your accounts is included in this Agreement and should be required by you to execute it.
All On-Line Banking Services offered by Valley Bank of Helena are governed by this agreement, as well as applicable Federal Regulatory disclosures and the Deposit Account Terms and Conditions of Valley Bank of Helena. All fee schedules published by Valley Bank of Helena from time to time will apply to the On-Line Banking Services. You are responsible for the payment of any fees on any account, for any service, and agree to pay all such fees upon request. You also agree to pay all telephone service charges or fees incurred by accessing On-Line Banking Services. On-Line Banking Services require you to have Internet access established.
1) My use of the On-Line Banking Services will confirm I have completed and reviewed this Agreement and applicable disclosures, which Valley Bank of Helena may amend from time to time. My initial use of any On-Line Banking Service in connection with my account(s) at Valley Bank of Helena constitutes my acceptance and agreement to be bound by all of the terms and conditions of this Agreement and of the Deposit Account Terms and Conditions.
2) A Password or PIN can be used to expend funds from my account and this code must be safeguarded. I authorize Valley Bank of Helena and its agents to follow any instructions transmitted by use of this code, and I agree to be bound thereby. If accessing an account, I certify I am authorized to use the PIN or Password. Valley Bank of Helena may act upon instructions received through any On-Line Banking Service under my PIN or Password without inquiring into the identity of the person using it. I will not, under any circumstances, disclose my PIN or Password to any unauthorized person. No employee of Valley Bank of Helena needs or should ever ask for my PIN or Password.
I am liable for all transactions made or authorized using my PIN or Password and Valley Bank of Helena has no responsibility for establishing the identity of any person or determining the validity of any transaction received using my PIN or Password. If I provide my PIN or Password to anyone, I intend to authorize any transactions carried out by that person. Valley Bank of Helena may assume all transactions authorized by my PIN or Password are legitimate. I hereby indemnify and release Valley Bank of Helena from any and all liability and agree not to make any claim against Valley Bank of Helena or bring any action against Valley Bank of Helena in honoring or allowing any actions or transactions where I have authorized the person performing the action or transaction to use my account or when I have provided my PIN or Password to that person.
3) I will notify Valley Bank of Helena at once if I believe another person has improperly obtained my PIN/Password or has carried out unauthorized transactions. I may ask Valley Bank of Helena to disable my PIN or Password and issue a new one to me.
4) You are liable for all transactions occurring on the account. The owner of the business account authorizes all transactions made by any other persons. The owner of the account agrees to be liable for any transactions directed by any other person given the PIN/Password to your accounts.
5) Valley Bank of Helena recommends you maintain up-to-date virus protection software on your computer, change your PIN/Password every 90 days, never open e-mail attachments from an unknown source and never provide personal account information via e-mail.
6) Each person on a multiple party account will be liable for all transactions made on that account. Each person on a multiple party account authorizes all transactions made by any other signer(s) on the account(s). Each owner(s) on a multiple party account(s) agrees to be liable for the actions of the other owner(s) on the account. The limitations of liability set forth in this Agreement are subject to, and limited by any state or federal law.
7) Valley Bank of Helena has the right to modify or terminate this Agreement or the Deposit Account Terms and Conditions at any time, and will comply with all legal notice requirements. Once this Agreement is terminated, Valley Bank of Helena may not allow any additional transactions on the account, nor will additional On-Line Banking Services be permitted. If this Agreement is modified, my continued use of the Account will represent my acceptance of the changes.
8) To take advantage of other On-Line Banking and Bill Payment Services offered by the bank, I must complete this agreement and establish basic On-Line Banking Services. All services added are covered under this Agreement. My signature authorizes Valley Bank of Helena to carry out transactions under any other On-Line Banking Services I use at a future date, such as Bill Payment Services. By using any new service, I agree to be bound by the terms communicated to me.
9) Valley Bank of Helena will not provide any receipt or documentation of transactions other than regular account statements.
